Farmer’s Egg, itself, complies with intellectual property laws and industry best practices to maintain the integrity of our creative marketplace. Our Intellectual Property Policy sets forth how Farmer’s Egg addresses infringement allegations, how notices of infringement may be submitted and how our Member can respond. This Intellectual Property Policy is considered a part of our Terms of Use.

Reporting
If you believe another Member has violated your intellectual property rights in your products or services, you need to submit a report to Farmer’s Egg by sending the information below toinfo@farmersegg.com. If you would like to submit a notification of alleged infringement, counter a notice of copyright infringement submitted against you, or withdraw a notification of infringement that you submitted, please refer to the following information.
Submit the following information to Farmer’s Egg to make a claim of copyright infringement:
your name and contact information;
your company name, and website address, if applicable;
identification of your copyright being infringed, including any official registration details and information;
the URL of the www.farmersegg.com site being reported and the exact content/aspect of that site;
a clear and detailed explanation of how the above content is in violation of your copyright, thus creating consumer confusion;
a statement that the information you have provided is accurate and under penalty of perjury that you have a good faith belief that use of the copyright in the manner complained of is an infringement of the rights granted under United States law;
your physical or electronic signature as the owner or person authorized to act on behalf of the owner of the copyright that is allegedly infringed;
your consent to forward the infringement complaint to the other Member, including your contact information; and
A signature of a person authorized to act on behalf of the intellectual property owner whose right has been allegedly infringed upon -- signatures may be provided electronically by typing your name.
Submit the following information to Farmer’s Egg to counter a copyright infringement notice submitted against you.
Identification of the material that has been removed or to which access has been disabled;
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material;
Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal Court for the judicial district in which you are located, or if your address is located outside the United States, for any judicial district in which Farmer’s Egg is located, and that you will accept service of process from the person who provided the original notification or an agent of such person; and
Your signature -- signatures may be provided electronically by typing your name;
Farmer’s Egg only accepts withdrawals of infringement notices from the intellectual property owner or an authorized representative. The intellectual property owner or the authorized representative must email info@farmersegg.com directly to withdraw a claim of infringement. The communication must clearly state that it is a formal withdrawal and sufficiently identify the relevant Member and/or material (such as by providing the relevant username, shop name, and/or Farmer’s Egg URLs).

Notices of Intellectual Property Infringement Farmer’s Egg will respond quickly when it receives a notice of intellectual property infringement by removing or disabling access to the allegedly infringing material. When Farmer’s Egg removes or disables access in response to a notice, it will make a reasonable attempt to contact the allegedly infringing party, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about counter notification. Farmer’s Egg may provide a copy of the notice of infringement to the allegedly infringing party.
Counter Notification If Farmer’s Egg receives a DMCA counter notification, Farmer’s Egg, in its sole discretion, may have the removed material replaced or access to it may be restored 10 business days after receipt of the counter notice, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs Farmer’s Egg of this action. Farmer’s Egg will send a copy of the counter notice to the original complaining party.
Repeat Infringement At its sole discretion, Farmer’s Egg will terminate account privileges of members that are subject to repeat notices of intellectual property infringement.
